NJ cannabis laws, explained like a human.
Weed is legal in New Jersey — but the rules are specific, and a couple of them surprise people. Here's the whole picture in plain English.
How much can you buy?
Up to 1 ounce of flower per transaction — or the equivalent spread across product types. You can mix it: a half ounce of flower plus a couple grams of concentrate in the same order is fine, as long as the combined total stays under the 1-ounce equivalent. You must be 21 or older with a valid government ID (any state's ID works — you don't need to be an NJ resident).
How much can you carry?
Can you grow your own?
No — and this is the one that surprises everyone. New Jersey is one of the only legal states where growing your own remains fully illegal for recreational users. Even a single plant is a third-degree crime: up to 5 years and a $25,000 fine. Until Trenton changes it, the only legal weed in NJ comes from licensed dispensaries and delivery services.
Is delivery legal?
Yes. Licensed operators (Class 6 delivery license or a delivery endorsement) can bring it to your door. Here's the part most people don't know: even if your town banned dispensaries, it cannot block delivery to your address. The town opt-out controls where cannabis businesses set up shop — not where residents receive orders. See which services deliver near you.
Where can you actually smoke?
- Your own property — the safe default (renters: your lease can prohibit it).
- Licensed consumption areas — a small but growing list.
- Not in public — treated like public smoking restrictions; you can be fined.
- Never in a car — driver or passenger, moving or parked. Driving high is a DUI, full stop.
The quick hits
- Legal age: 21+, any government-issued ID.
- Buy: 1 oz equivalent per transaction, licensed dispensaries or delivery only.
- Carry: up to 6 oz.
- Grow: illegal, no exceptions for recreational users.
- Out-of-state: what you buy in NJ stays in NJ — crossing state lines with it is a federal problem.
