Welcome to bloem. ("we," "us," "our"), operated by VinPro Capital LLC. These Terms of Service ("Terms") govern your use of mybloem.com and the notifications, alerts, and services we provide. By creating an account, signing up for alerts, or using this site, you agree to these Terms and our Privacy Policy.

1. Who Can Use bloem.

You must be 21 years of age or older to use this platform. By using bloem., you represent that you are 21 or older. We may terminate any account we believe belongs to someone under 21.

2. What bloem. Is (and Isn't)

bloem. is an information and notification platform. We help you discover product drops, deals, events, and licensed retail locations near you, and we send you alerts you've asked for.

• We do not sell, deliver, or fulfill any cannabis products.
• All products referenced on this platform are sold exclusively by independent, state-licensed businesses. Any purchase you make happens directly with that business, on their terms, subject to New Jersey law.
• Deal, event, and availability information is provided by third parties and may change or contain errors. Always confirm details with the retailer before making a trip.

3. Alerts and Marketing Messages

When you sign up, you choose to receive marketing and notification messages from bloem. — including messages sent on behalf of the brands you follow — by email and, if you opt in, by text message (SMS).

• Consent: Signing up with your phone number and checking the consent box constitutes your express written consent to receive recurring marketing texts from bloem. at that number. Consent is not a condition of any purchase.
• Frequency: Message frequency varies. Message and data rates may apply.
• Opting out: Reply STOP to any text to stop all texts from us. Reply HELP for help. Every email includes an unsubscribe link. You can also mute a single brand without leaving the platform by contacting us.
• Quiet hours: We do not send marketing texts late at night or early in the morning.

4. Your Account and Your Data

You agree to provide accurate information when you sign up. You are responsible for the accuracy of your contact details. Our collection and use of your information — including how zip-code-level engagement and redemption data is shared with brand and retail partners — is described in the Privacy Policy.

5. Brand and Retail Partner Services

If you are a brand or licensed retailer using bloem.'s partner services (audience building, drop notifications, brand-day promotions, reporting), the following applies:

• Partner services are provided under a separate agreement or written arrangement; these Terms apply in addition to it.
• Reports we provide (list growth, engagement, redemptions) are for your internal business use.
• You are solely responsible for your own regulatory compliance, including product marketing rules that apply to licensed cannabis businesses in New Jersey.
• We may decline or discontinue partner service at our discretion, including where content or conduct creates legal risk.

6. Acceptable Use

You agree not to: misrepresent your age or identity; scrape, harvest, or resell data from the platform; interfere with the platform's operation; use the platform for any unlawful purpose; or submit content that is false, infringing, or harmful.

7. Intellectual Property

The bloem. name, site design, and platform content are owned by us or our licensors. Brand names, logos, and product imagery belong to their respective owners and are used for identification and promotion with permission.

8. Disclaimers

The platform is provided "as is" and "as available." We make no warranties about the accuracy, completeness, or timeliness of deals, events, pricing, or availability. Nothing on this platform is medical advice. We are not responsible for the acts, omissions, products, or services of any third-party business listed or promoted on the platform.

9. Limitation of Liability

To the fullest extent permitted by law, VinPro Capital LLC and bloem. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of the platform. Our total liability for any claim relating to the platform will not exceed one hundred dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless VinPro Capital LLC, bloem., and their owners and personnel from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the platform.

11. Termination

We may suspend or terminate your access to the platform at any time, with or without notice, for conduct that violates these Terms or creates risk for us, other users, or partners. You may stop using the platform and request deletion of your data at any time.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in New Jersey.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the platform after changes take effect means you accept the updated Terms.
